TERMS AND CONDITIONS

In accordance with the provisions of the Real Estate Brokerage, Class: 001-01 / 07-01 / 128, Reg 001-01 /07, from the 2nd of November 2007, and the Law on Amendments to the Law on Brokerage in real estate (NN 144/2012), Agency HISTRIA APART Ltd (Hereinafter referred to as agent) adopts:

GENERAL PROVISIONS

Obligations of the agent

to conclude the brokerage agreement with the principal
to find principal/property in order to conclude the contract for which the agent has mediated/brokered
to estimate market value of the property and to inform the principal about the findings
to inform the principal about all property deficiencies and update on the market conditions
to obtain all relevant documents and show them to the principal
to inform the principal on all legal, tax and other obligations and fees which may arise during and after the brokering (buying/selling) process
to advertise to property
to organize inspection visits to the properties
to keep vendor’s data and other personal data as a business secret and in line with the best business practice in line with GDPR (25.05.2018.)
to inform the principal on all known circumstances which might have impact on the buying/selling process
to mediate in the negotiations and attempt to conclude the whole brokerage (buying/selling) process
to prepare all legal acts necessary to transfer the ownership (contract, preliminary contract) using a solicitor
to facilitate the property handover.

Obligations of the principal – vendor
to conclude brokerage agreement with the agent
to present all the available documents regarding the real estate (property) to the agent
to inform the agent about all relevant information regarding the property
to allow inspection visits to agent and his principals (buyers)
to pay the agreed commission to agent
to cover all expenses which arose during the brokerage and which are not otherwise considered as standard costs.
to immediately and with no delay inform the agent about all changes which might have occurred regarding the property after the brokerage agreement has been signed.

Obligations of the principal – buyer
to conclude brokerage agreement with the agent
to pay the agency commission

Agency commission

Buyer's commission amounts from 3 % + VAT of the purchase price.

Vendor's commission amounts from 3 % + VAT of the purchase price.
